Any order placed in the Client necessarily implies, as an essential, decisive and indispensable condition, the unreserved acceptance by the Client of the General Terms and Conditions of Use in force on the day on which the corresponding order is placed. In addition, the Client acknowledges that the acceptance of these conditions will imply the application of these conditions to the order to which they refer, as well as to any subsequent order, with the exception of those cases in which new conditions are made known to them. 

USERS 

To be able to purchase any of the products shown in  https://www.herbolariomieldemar.com  or those that you request through the contact form established for this purpose, for this the user must be legally qualified in accordance with the Spanish Legal System. 

PURCHASE  PROCEDURE

Choose: choose the desired product, click on it, and you will see a detailed description of it. From the product itself, it can be added to the shopping cart. 

Purchase: once in the cart, you will have to follow the steps established for the confirmation of the purchase and provide the required data. 

Confirmation: once you have logged in, all you have to do is confirm the order. 

At the end of your order, you will be sent an email confirming receipt of your order, and specifying all the details of the order. If you notice an error at the address indicated or at any other point in the order, you must notify us immediately so that the error can be corrected.

PRICES 

Prices published in https://www.herbolariomieldemar.com are in Euros and are valid except for typographical errors. 

Through the website https://www.herbolariomieldemar.com you can consult at any time the current rates that include VAT and are specified in each of the products. 

PAYMENT  METHODS

Payment will be made through any of the following means: 

Credit or debit card purchases:  the user must provide the cardholder's name, number, expiry date and CVV. Payment can be made with Visa, Mastercard, Maestro and American Express cards.  

SHIPMENTS 

We always ship orders after confirmation of payment, except for cash on delivery payments , until 14:00. 

  • Mainland Spain: we ship with delivery 48/72 hours on the next working day from Monday to Friday, after the goods have been dispatched. There are special delivery services: 
    • Before 1:30 p.m. 
    • Saturdays before 1:30 p.m.

I HAVE RECEIVED A PACKAGE THAT HAS BEEN TAMPERED WITH OR WITH A BLOW

Sometimes, much to our regret, a package is damaged during transport and affects the items inside. If you have found a damaged package or with signs of tampering and the products in it are affected, we will take care of solving it immediately.

Please contact us through our telephone number at 631 97 94 33. You will need to indicate your email address and the order affected by this incident.

Keep in mind that a cardboard box may have a bump, but the products inside are perfect. The reason for the existence of packaging is precisely to protect the products, so it is advisable that you open the box carefully and check if the contents are perfect. If there is no physical damage, there is no reason to report a transportation incident.

You have 72 hours from the moment you receive the order to check the goods and report a transport incident.

Normally, we won't ask you for pictures of the condition in which you received the package, but you can do them in case it helps to have them at some point.

On the other hand, if there is no physical damage, but then you find that some product does not work as it should, what proceeds is the warranty and eventual replacement with a new unit.

RIGHT OF WITHDRAWAL 

The user may revoke the purchase or withdraw from the contract within 14 calendar days without the need for justification. The withdrawal period shall expire 14 calendar days after you or a third party indicated by you, other than the carrier, acquired physical possession of the goods. 

To exercise the right of withdrawal, you must notify us of your decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You also have the option of completing and sending the model withdrawal form or any other unequivocal statement by filling in the withdrawal document sent in the purchase confirmation email. If you use this option, we will inform you without delay, on a durable medium, of the receipt of such withdrawal.  

If the reason for the return is that the returned item is defective or does not correspond to what was requested in the order, HERBOLARIO MIEL DE MAR will bear the costs of the return and reshipment.  

If the reason for the return is that you are not satisfied with the order: 

  • We will refund the amount, including delivery costs (except for delivery costs if you have chosen an option other than ordinary delivery, in which case only the costs allocated by the website for ordinary delivery will be refunded) without any undue  delay
  • The refund will be made no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.  
  • You will be responsible for the direct cost of returning the goods. 
  • The refund will be made using the same means of payment that was used in the initial transaction, unless you have expressly stated otherwise, and provided that it does not entail additional costs. 
  • The Company reserves the right to withhold the refund until it has received the goods, or until you have provided proof of the return of the goods, whichever comes first. 

GUARANTEE 

All our products have at least a 6-month warranty for professionals and a 12-month warranty for individuals, for which HERBOLARIO MIEL DE MAR is responsible as the seller of the product, in the legally established terms. 

In the same way, manufacturers offer a commercial warranty that, on occasion, can improve the terms and conditions of the legal warranty. That is why it is very important that you read the warranty conditions of each product, and keep the proof of purchase, as they will be necessary to benefit from the warranty. 

Deficiencies caused by negligence, shocks, improper use or handling, unsuitable voltage, incorrect installation not carried out by the authorized Technical Service where applicable, or materials subject to wear and tear due to normal use are not included. 

In those incidents that justify the use of the warranty, the option will be for repair, replacement of the item, discount or return, in the legally established terms.

GOVERNING LAW AND FORUM 

This purchasing system is subject to the legislation in force in Spain (Civil Code, Commercial Code, Law 7/1998, on the General Conditions of Contract, Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws,  and Law 34/2002 on Information Society Services and Electronic Commerce).  

In accordance with Law 34/2002, of 11 July, the contract will be presumed to have been concluded at the seller's domicile (Spain). If, as the case may be, there are disagreements that may arise as a result of this contractual relationship and cannot be resolved amicably, it will be submitted to the Courts that are considered competent in each case.
